**Our Return Policy**
Our return policy is valid for 14 days after receiving your order. Unfortunately, if 14 days have passed since you received your package, we cannot offer you a refund or exchange.
To be eligible for a return, your item must be in the same condition as when you received it: unworn or unused, with tags, and in its original packaging.
Certain types of items cannot be returned. Perishable goods like food, flowers, or magazines cannot be returned. We also do not accept returns on intimate products, hazardous materials, or flammable gases or liquids.
Other non-returnable items include gift cards.
To complete your return, you must provide a receipt or proof of purchase.
Please do not send your purchase back until we have provided you with the return address.
There are certain situations where only partial refunds are granted (if applicable):
- Any item not in its original condition, damaged, or missing parts for reasons not due to our error.
- Any item returned more than 14 days after delivery.
**Refunds (if applicable)**
Once we receive and inspect your returned item, we will send you an email confirming receipt. We will also notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your credit card or original payment method within one to two business days.
**Late or Missing Refunds (if applicable)**
If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, as it may take some time before your refund is officially posted. Next, contact your bank. There is often some processing time before a refund is posted. If you still have not received your refund after these steps, please contact us at help@gag-gift.com.
**Exchanges (if applicable)**
We only replace items if they are defective or damaged. If you need to exchange it for the same item, please email us at help@gag-gift.com.
**Gifts**
If the item was marked as a gift when purchased and shipped directly to you, you will receive a gift credit for the value of your return. Once the returned item is received, a gift voucher will be sent to you by email. If the item wasn’t marked as a gift when purchased or if the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver, who will be informed of your return.
**Shipping**
To return an item, please email us at help@gag-gift.com.
You will be responsible for paying the shipping costs for returning your item. Shipping costs are non-refundable.
Depending on where you live, the time it may take for your exchanged product to reach you may vary.
If you are shipping an item over $75, consider using a trackable shipping service or purchasing shipping insurance. We cannot guarantee that we will receive your returned item.

**ARTICLE 11 - PRODUCT AVAILABILITY - RETURNS - CANCELLATIONS**
Except in cases of force majeure or during closures of the online shop announced on the website's homepage, the shipping times indicated below apply, subject to product availability. Shipping times start from the date of the order confirmation, as stated in the confirmation email.
For deliveries, a period of 8 to 14 business days applies from the date the buyer places their order.
If the agreed delivery date or time is not met, the buyer must give the seller a reasonable extension before withdrawing from the contract.
If performance is not completed after this new period, the buyer may withdraw from the contract at their discretion.
The buyer must complete these successive steps by registered letter with acknowledgment of receipt or through a written notification on another durable medium.
The contract is deemed terminated upon the seller's receipt of the letter or notification of this termination unless the seller fulfills the contract in the meantime.
However, the buyer may immediately terminate the contract if the dates or timeframes mentioned above constitute an essential condition of the contract for them.
If the contract is terminated in this case, the seller must refund all amounts paid by the buyer within fourteen days of the contract termination date.
If the ordered product is unavailable, the buyer will be informed as soon as possible and given the option to cancel their order. The buyer may then choose either a refund of the paid amounts within fourteen days of delivery or an exchange of the product.
The buyer may return their products within fourteen days of the delivery date for a full refund of the purchase price.
The product must be in its original condition, unused, undamaged, and unopened.
Refunds cover only the price of the product, not shipping costs.

**ARTICLE 12 - DELIVERY CONDITIONS**
Delivery refers to the transfer of physical possession or control of the goods to the consumer. The ordered products are delivered following the terms and deadlines mentioned above.
The products are delivered to the address specified by the buyer on the order form; the buyer must ensure this address is accurate. Any package returned to the seller due to an incorrect or incomplete delivery address will be reshipped at the buyer’s expense. The buyer may request that an invoice be sent to the billing address instead of the delivery address by selecting the appropriate option on the order form.
If the buyer is not home on the delivery day, the carrier will leave a notification in the mailbox, allowing the package to be picked up at the specified location and time.
If the original packaging is damaged, torn, or opened at the time of delivery, the buyer must check the item’s condition. If they are damaged, the buyer must refuse the package and make a note on the delivery slip (package refused due to being opened or damaged).
The buyer must record any delivery issues (missing items compared to the delivery slip, damaged package, broken products, etc.) on the delivery slip and sign it.
This check is considered complete once the buyer or an authorized person has signed the delivery slip. The buyer must then confirm these issues with the carrier within two business days of receiving the item(s) via registered mail and send a copy of this letter to the email address provided in the website's legal notice.
If products need to be returned to the seller, a return request must be made within 14 days of delivery. Complaints received after this period will not be accepted. Product returns can only be accepted for items in their original condition (packaging, accessories, etc.).

**ARTICLE 13 - DELIVERY ERRORS**
The buyer must notify the seller on the day of delivery or at the latest on the first business day following delivery of any complaints about delivery errors and/or non-compliance with the products’ type or quality as listed on the delivery slip. Any complaint submitted after this period will be rejected.

Any complaints not submitted according to the above rules and within the time limits cannot be considered, releasing the seller from any responsibility towards the buyer.
Upon receipt of the complaint, the seller will assign a return authorization number to the product(s) in question and communicate it to the buyer by email. A product can only be exchanged after the return number is assigned.
In the event of a delivery or exchange error, any item to be exchanged or refunded must be kept in its entirety and original packaging.
In the case of a delivery or exchange error, each item to be exchanged or refunded must be returned in its entirety and in its original packaging via Colissimo Recommandé to the address provided by the seller by email.
The return shipping costs are the responsibility of the buyer.

**ARTICLE 14 - PRODUCT WARRANTY**
**14-1 LEGAL WARRANTY OF CONFORMITY**
The seller guarantees that the goods sold conform to the contract, allowing the buyer to make a claim under the legal warranty of conformity according to Articles L. 217-4 of the Consumer Code.
In case of application of the legal warranty of conformity:
- The buyer can act within two years from the date of delivery of the goods;
- The buyer can choose between repair or replacement of the goods, subject to the cost conditions in Article L. 217-17 of the Consumer Code;
- The buyer does not have to provide proof of non-conformity of the goods within 24 months of delivery (6 months for used goods).

**14-2 LEGAL WARRANTY AGAINST HIDDEN DEFECTS**
According to Articles 1641 of the Civil Code, the seller is required to guarantee against hidden defects in the sold product that make it unsuitable for its intended purpose. It is the buyer's responsibility to prove that the defects existed at the time of sale and that they render the item unsuitable for its intended purpose. This warranty must be claimed within two years of discovering the defect.
The buyer may choose between canceling the sale or a price reduction under Article 1644 of the Civil Code.

**ARTICLE 15 - RIGHT OF WITHDRAWAL**
**APPLICATION OF THE RIGHT OF WITHDRAWAL**
According to the provisions of the Consumer Code, the buyer has 14 days from the delivery date to return any item that does not suit them and request an exchange or refund without penalty.
Returns must be in their original, complete condition (packaging, accessories, instructions, etc.) to enable resale in new condition.
Damaged, soiled, or incomplete products will not be accepted.
The right of withdrawal may be exercised online using the withdrawal form available on this website. In this case, the buyer will promptly receive an acknowledgment on a durable medium. Any other form of withdrawal statement is accepted if it is clear and expresses the intent to withdraw.
If the right of withdrawal is exercised within the above period, only the product price(s) will be refunded.
Return shipping costs are the responsibility of the buyer.
Exchanges (subject to availability) or refunds will be processed within 48 business days and no
later than 14 days from the date on which the seller receives the returned products under the conditions mentioned above.

**EXCLUSIONS**
According to Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts:
- For goods whose price depends on financial market fluctuations beyond the seller's control that may occur during the withdrawal period;
- For goods made to customer specifications or clearly personalized;
- For goods that may deteriorate quickly or expire soon;
- For goods unsealed by the consumer after delivery that cannot be returned due to health protection or hygiene reasons;
- For goods inseparably mixed with other items after delivery due to their nature;
- For audio or video recordings or software that have been unsealed by the consumer after delivery;
- For newspapers, periodicals, or magazines, except for subscriptions to such publications;
- For digital content not supplied on a physical medium, where performance has begun after the consumer’s prior express agreement and express waiver of their right of withdrawal.
